Obtaining an export controls licence to work with controlled data

If your collaborator or funder is based in the UKYou will not require a licence to undertake controlled work or publish it

  • You will not require a licence to undertake controlled work or publish it.
  • You will be required to use the following statement in your communications with your collaborators in the UK (emails, presentations, etc):

 “This [goods/software/information] is [a] UK Export controlled [goods/software/information], categorised by code XXX of the UK consolidated list. A licence may be required by your organisation to export this [goods/software/information] outside the UK: it is your organisation’s responsibility to check whether such a licence is required.” 

If your collaborator or funder is not based in the UK

  • You may require a licence to undertake controlled work (regardless of whether you intend to publish it or not) to cover any exchange of controlled data between you and your collaborators. Any licence put in place will also cover any subsequent publication.
  • You need to first check if an OGEL is applicable to your project using the OGEL checker. To do this, you need to enter the entry code you have identified along with the country where the entity is based end-user and the consignee destination if applicable.
  • Once you have identified that an OGEL is applicable to your project, please complete the Export Controls Compliance request online form immediately so that the Regulatory Compliance Team can provide you with necessary guidance on the conditions/requirement of the applicable OGEL licence.
  • More information on the conditions of the OGEL licence and record keeping as required by ECJU can be found here.
  • Where an OGEL is not applicable to your project, you will need to apply for a SIEL licence.
  • To apply for a SIEL licence to export controlled items to any country outside the UK fill in and submit an online form with the RC Team.
  • Until you receive clearance (confirmation that a licence isn’t required or that a licence has been granted), you can continue with high-level discussions with your collaborators, but do not share any technical information, research data, or knowledge which is not publicly available.
