What are End User Certificates?
An End User Undertaking (EUU) or an End User Certificate (EUC) is a document that the recipient of item (tangible or intangible) signs to provide assurance of compliance with national and/or international laws and to certify that the recipient does not plan on transferring the items further or using them for other purposes.
You may be asked to request your collaborators to sign an EUU as part of the process of an Export Licence Application (ELA). These EUU documents are only valid within 6 months of the date of the submission of the ELA.
You may receive an EEU or EUC with your receiving items (e.g., as part of purchasing them or as part of a consultancy) from companies located both in the UK and outside the UK. You MUST NOT sign these EUCs! Only a handful of University authorised signatories can sign EUCs on behalf of the University.
If you are asked to get a signature for an EUU
The EUU required for your Export Licence Application (ELA) will be prepared by the Regulatory compliance Team (RC Team) matching the exact wording of the ELA. You do not need to sign this document; however, you will be asked to contact your collaborator for signature.
Important to note:
a. that the same person signing the EUU must also provide a covering letter (signed and dated). This letter must be on their original official headed paper. If the end-user or stockist end-user is an individual, then the documents do not have to be on letter-headed paper.
b. all sections of the EUU are completed legibly and in English (or accompanied by an authorised translation, including header details, if written in a foreign language).
If you receive an EUC from an external company or institution
a. There is only a handful of University authorised signatories that can sign these EUCs. However, the authorised signatory will require assurances from the Regulatory Compliance Team that the University processes in place are mitigation measures for the risk identified in the EUCs before they sign such documents. The RC Team will draft a Guidance Control Plan (GCP) stating the measures that must be met to provide assurance to the authorised signatories. You will have to sign the GCP as responsible person using/storing the item.
b.You MUST submit a request to the RC Team via the online form, selecting the option in question number 7 of “Checks for assurance related to End-User Undertakings forms/certificates/letters”.
